Terms of Use

1. Purpose

These Terms of Use define the terms and conditions governing use of the ARTsynonyme platform and the rights and obligations of its users.

By accessing and using the platform, you accept these Terms of Use without reservation.

2. Description of the service

ARTsynonyme is an online showcase platform connecting artists, galleries and collectors.

In particular, the service allows:

  • Artists to create a profile, publish and manage their artworks, and communicate with potential buyers
  • Galleries to present their gallery, the artists they represent and their artworks
  • Collectors to discover artists and galleries, browse artworks and contact them

3. Registration and user accounts

3.1 Creating an account

Access to certain platform features requires a user account. When registering, you undertake to provide accurate, complete and up-to-date information.

3.2 Account types

  • Artist account: For creators wishing to present their work and, where applicable, offer artworks for sale
  • Gallery account: For galleries wishing to present their activity, represented artists and artworks
  • Collector account: For art lovers wishing to discover and acquire artworks

3.3 Artist registration arrangements

Artist registration is open to everyone. The public form immediately creates an account with “pending approval” status. The artist can access a private workspace to complete their profile and manage their artworks, but their profile and artworks remain unavailable to the public until they are approved by the administration.

The artist submits at least three valid photos of their work. These photos are required to verify the artistic nature of the registration and help prevent fraud or abusive use of the Platform. A website, portfolio or Instagram link is recommended but optional. The artist is informed of the administrative decision by email.

ARTsynonyme may also create and directly activate an Artist account for an artist previously approved by the administration. The administration may then send the artist personal access allowing them to set their password and manage their own profile and artworks.

Gallery and Collector accounts may be registered through the public form and remain pending administrative approval until they are activated.

3.4 Account security

You are responsible for keeping your login details confidential. Any activity carried out through your account is presumed to have been carried out by you.

4. User obligations

4.1 General obligations

You undertake to:

  • Comply with applicable laws and regulations
  • Refrain from infringing third-party rights, including privacy, image and intellectual property rights
  • Refrain from publishing unlawful, pornographic or sexually explicit content, content depicting or facilitating sexual exploitation or non-consensual acts, or any sexualised representation of a minor
  • Refrain from publishing content that incites hatred, discrimination, violence, harassment, fraud or any other unlawful activity

Artistic nudity is not prohibited in itself. ARTsynonyme assesses the work’s context, presentation, artistic nature, accessibility to the public and compliance with these Terms of Use, applicable law and the Platform’s editorial direction.

4.2 Obligations specific to artists

  • Guarantee that they are the author of the published artworks or hold the necessary rights
  • Provide accurate descriptions and faithful images of their artworks
  • Observe the advertised prices and timescales
  • Fulfil orders under the accepted conditions

4.3 Obligations specific to collectors

  • Respect artists’ work
  • Refrain from using images of artworks for commercial purposes without permission
  • Honour purchase commitments

4.4 Caution in communications between users

The Platform’s messaging service allows users to communicate freely, but ARTsynonyme does not take part in payment for an artwork at any time. Each user therefore undertakes to:

  • never agree to refund an “overpayment” following a payment greater than the agreed price;
  • never accept a banker’s draft, particularly one issued by a foreign institution, without verifying that the funds have actually cleared before shipping or handing over the artwork;
  • be wary of any international transfer from a person whose identity has not been reasonably verified;
  • wherever possible, prefer payment on receipt or in person;
  • report to ARTsynonyme, through the contact form, any suspicious behaviour or approach resembling attempted fraud.

The user acknowledges having been informed of these risks, including through warnings displayed directly in the Platform’s messaging service. ARTsynonyme may suspend, without notice or compensation, any account whose activity shows signs of fraud or attempted fraud.

5. Published content

5.1 Responsibility for content

You are solely responsible for content that you publish on the platform. ARTsynonyme cannot be held liable for content published by users.

5.2 Moderation

ARTsynonyme may review content before or after publication and, without compensation, reject it, keep it private, restrict its visibility, unpublish it or delete it if it breaches these Terms of Use, applicable law, third-party rights or the Platform’s editorial direction.

Content that is pornographic, sexually explicit, non-consensual, exploitative or involving a minor may be removed or made inaccessible immediately. Artistic nudity is assessed in accordance with Article 4.1 and is not automatically treated as pornographic content.

ARTsynonyme may temporarily suspend an account while checks are carried out. A serious or repeated breach may result in suspension or deletion of the account under Article 8.2. Except where urgency, safety or the law prevents it, the user is informed of the reason and may contact ARTsynonyme to request a review.

5.3 Intellectual property

You retain all intellectual property rights in the content you publish. However, you grant ARTsynonyme a non-exclusive licence to display, reproduce and distribute that content for the operation of the platform.

For artists and galleries, this licence covers displaying your artworks on the Platform, including artwork pages, profiles, the catalogue and search engine. Any use of your images outside the Platform — in particular on ARTsynonyme’s social networks, in a presentation of the artist or in a commercial offer from ARTsynonyme — requires your prior consent, given through the optional “Consent” checkbox in your profile. You may withdraw this consent at any time by clearing the checkbox.

6. Transactions and payments

6.1 Nature of the platform

ARTsynonyme is a platform that connects users. Transactions between artists and collectors are concluded directly between them.

6.2 Prices

Displayed prices are set by the artists. ARTsynonyme does not take part in setting prices.

6.3 Commission

ARTsynonyme is currently a free showcase website and charges no commission on artwork sales concluded directly between users. This absence of commission does not affect any representation or commission agreements concluded outside the Platform between an artist and a gallery, which remain the sole responsibility of the parties concerned.

7. Personal data protection

Your personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).

8. Termination

8.1 By the user

You may close your account at any time by contacting us at: support@artsynonyme.com

8.2 By ARTsynonyme

ARTsynonyme may restrict, suspend or delete an account, without compensation, if these Terms of Use are breached, in the event of fraud or attempted fraud, publication of prohibited content, infringement of third-party rights, a security risk, or repeated misuse of the Platform.

The measure is determined according to the nature, seriousness and recurrence of the breach. ARTsynonyme may act without prior warning where the content or conduct is manifestly unlawful, serious or urgent. In other cases, the user may be warned or temporarily suspended before the account is deleted.

9. Limitation of liability

ARTsynonyme makes every effort to ensure that the platform operates correctly, but does not guarantee:

  • Permanent availability of the service
  • That the service is free from errors or bugs
  • Absolute data security

ARTsynonyme cannot be held liable for direct or indirect loss resulting from use of, or inability to use, the platform.

ARTsynonyme also cannot be held liable for financial or other loss resulting from a transaction concluded between users, including in the event of fraud, non-payment, non-delivery or a dispute over an artwork’s conformity; see Articles 4.4 and 6.

For content stored at a user’s request, ARTsynonyme processes reports in accordance with Regulation (EU) 2022/2065 on digital services and French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN). ARTsynonyme acts promptly to remove or disable access to manifestly unlawful content as soon as it becomes aware of it. A report may be submitted through the contact form or by email to contact@artsynonyme.com, specifying the content concerned, its location and the reasons for the report.

10. Changes to the Terms of Use

ARTsynonyme reserves the right to amend these Terms of Use at any time. Users will be informed of changes by email or through a notification on the platform.

Continued use of the platform after a change constitutes acceptance of the new Terms of Use.

11. Governing law and disputes

These Terms of Use are governed by French law. An amicable solution will be sought before any legal action is brought.

If no agreement is reached, the French courts shall have exclusive jurisdiction.
